Tender disputes are not being recognized because appeals were submitted to KIO via e-Delivery

Following this, the Public Procurement Office (Urząd Zamówień Publicznych, UZP) issued a statement urging users to make use of an alternative method, specifically the e-Delivery system.
Despite overcoming the initial problems with the ePUAP platform, the UZP continues to recommend using the e-Delivery system for submitting appeals. Notably, the specific form for appeals on the ePUAP platform has been removed, leaving only a general document submission option. This change has understandably led many contractors to prefer e-Delivery, which has proven to function reliably. However, a significant concern arises as some appeals submitted through e-Delivery are still not being acknowledged substantively, leading to potential legal ramifications for the parties involved and raising questions about the effectiveness of the new submission channels.
This situation illustrates the challenges faced by contractors navigating the public procurement landscape in Poland, especially given the integration of new digital systems meant to streamline processes. As such, both the Public Procurement Office and the National Appeals Chamber may need to assess and adapt their strategies to manage appeals better, ensuring that all parties can confidently utilize the platforms available to them and reducing the likelihood of procedural issues that can hinder the resolution of tender disputes.
