Special Prosecutor adds complicity charges against Kim Geon-hee in the Deutsche Motors stock manipulation appeal trial... requests amendment of the indictment
The special prosecutor's team has requested an amendment to the indictment in the appeal trial for Kim Geon-hee to include charges of complicity in the Deutsche Motors stock manipulation.
The special prosecutor's team, led by Min Jung-ki, has filed a request to amend the indictment in the appeal trial against Kim Geon-hee regarding her alleged involvement in stock manipulation at Deutsche Motors. This comes after the first trial resulted in a complete acquittal for Kim on these charges. The amendment seeks to include the possibility of complicity as a secondary charge, indicating that the prosecution wishes to explore her involvement further if the primary charges are not upheld in the second trial.
During a previous verdict in January, the Seoul Central District Court found Kim Geon-hee not guilty of profiting 800 million won through stock manipulation related to Deutsche Motors, citing lack of active participation in the scheme. The court acknowledged her awareness of the scheme but ruled that she was not directly involved in the actions that constituted the manipulation. Key points in their decision included the unusually high commission fee she allegedly agreed to pay for the assistance she expected to receive from market manipulators, and inconsistencies in her testimony.
However, the court's judgment also highlighted testimony from the key figures in the manipulation scheme, asserting that no direct evidence was presented showing that Kim was informed of the manipulative activities. This led to the conclusion that she acted as an outsider, although the special prosecutor’s team maintains that she was either a co-conspirator or at least complicit in the actions against the law. The evolution of the case and the prosecution's strategy suggests they are looking to strengthen their position in future legal proceedings as the appeal moves forward.
