Twenty-something Driver Charged for Drinking Alcohol at Convenience Store to Avoid Drunk Driving Detection

A 20-year-old driver was charged for obstructing a drunk driving test after entering a convenience store to drink beer before being apprehended by the police.

A young driver, identified only as Mr. G, was charged by the Gwangju Northern Police for evading DUI detection after he entered a convenience store minutes before being stopped by the police. On the morning of March 15th, Mr. G was driving with alcohol in his system from the city of Seo-gu to Buk-gu in Gwangju when he was flagged by a citizen who reported his erratic driving. As the police arrived, he ducked into a nearby convenience store and purchased a can of beer, claiming he only started drinking after exiting his vehicle. However, police tested Mr. G's blood alcohol content and found it to be at a level sufficient to warrant a license suspension. Despite his claims of drinking only after parking, officers determined, based on witness statements, that he had deliberately attempted to conceal his drunk driving by drinking while waiting for the police. This incident comes in the wake of legal reforms following a previous high-profile case in which a celebrity had similarly attempted to avoid consequences for drunk driving by consuming alcohol at a convenience store prior to police arrival. In 2023, the Korean National Assembly passed the "Kim Ho-jung Prevention Law" aimed at curbing such behaviors, stipulating that individuals who drink to hamper the results of a breathalyzer test can face severe penalties, including imprisonment of one to five years and fines ranging from five to twenty million won. Mr. G’s case illustrates the ongoing challenges and legislative measures in addressing drunk driving offenses in South Korea.
