"Road Maintenance" – Troubles: The Company Acknowledged Discriminating Against Its Employee
A Lithuanian company is under scrutiny for unjustly discriminating against an employee with a disability who was dismissed after a medical assessment questioned his ability to perform his job duties.
A recent investigation has revealed that a Lithuanian company, 'Kelių priežiūra', discriminated against an employee based on his health condition. The employee had begun working as a master last fall but was called in for a meeting shortly after submitting documents regarding his established disability. Despite possessing a valid medical certificate, the company asserted that due to his health status, he was incapable of performing his job functions. This ultimately led to the employee feeling pressured to leave his position.
Responding to queries from the Equal Opportunities Ombudsman's Office, representatives from 'Kelių priežiūra' defended their actions by stating they were following guidelines from the Agency for the Protection of the Rights of Persons with Disabilities (ANTA), which indicated restrictions on the applicant's work due to the nature of his condition. However, the investigative body found that the employer had unjustly restricted the employee's work responsibilities without sufficient justification.
According to the Equal Opportunities Ombudsman, B. Sabatauskaitė, existing legislation mandates that the suitability of employees for specific jobs should be determined by medical professionals through mandatory health assessments. This case raises significant concerns about how companies accommodate employees with disabilities and highlights the ongoing need for compliance with equal rights regulations in the workplace.
