The TSJ rejects investigating Mazón for managing the dana because he had no specific duties and it is not accredited that he participated in the Es-Alert
The TSJCV has unanimously decided not to investigate Carlos Mazón for his management during the dana, citing a lack of specific duties and no evidence of his participation in the Es-Alert.
The Plenary of the Civil and Criminal Chamber of the Superior Court of Justice of the Community of Valencia (TSJCV) has unanimously rejected the investigation of Carlos Mazón regarding his management during the dana. The TSJCV concluded that Mazón did not have 'specific duties and obligations,' which means he could not have committed the crime of homicide due to negligence by omission. Moreover, the court stated that there is no evidence indicating his participation in the incorrect and delayed dispatch of the Es-Alert message, as emphasized by the presiding judge. Therefore, the five magistrates did not find 'solid and objective grounds' for the claims presented by the judge from Catarroja to warrant a criminal case.
