Justice in Bavaria: Last Rescue Attempt for Wolfratshausen Illegal Constructions Fails
The owners of illegal constructions in Wolfratshausen have lost their final court battle to obtain permits for renovation or conversion into refugee housing.
In a long-running legal dispute concerning three illegal constructions on the Isarspitz in Wolfratshausen, the owners have definitively lost their case. They appealed to the Administrative Court in Munich in a last-ditch effort to obtain permits for their buildings to return to permissible dimensions. Additionally, they proposed to convert one of the buildings into a refugee accommodation, but the court dismissed both their claims on Friday, confirming the illegality of their constructions.
The Administrative Court firmly rejected the owners' attempts to obtain retrospective building permits as well as the request for the conversion of one of the properties for humanitarian use. The legal proceedings have highlighted the challenges faced by owners of illegal buildings attempting to navigate the legal system in Bavaria, especially as local laws are strict regarding unauthorized constructions.
As a consequence of the court's ruling, the demolition of the illegal structures is imminent. This case underscores the significant stance taken by the Bavarian justice system against illegal constructions, signaling to property owners the importance of obtaining the necessary permits before undertaking any building projects, regardless of the potential for later re-purposing of the properties.
