European Court of Justice: The gender chosen by transgender people must be taken into account in identification documents

The European Court of Justice (ECJ) issued a significant ruling concerning the case of a Bulgarian citizen challenging the refusal to issue a passport reflecting her gender identity as a woman. The court emphasized that EU regulations allow transgender persons to amend their gender status in personal identification documents, asserting that these regulations take precedence over national legislation that may be contradictory. The complainant, who initiated court proceedings in Bulgaria in 2017, expressed optimism regarding the ruling, which now enables her to obtain a Bulgarian passport that acknowledges her true identity. Her lawyer, Aleksandrs Shusters, shared her sentiments, underscoring the emotional and legal significance of being officially recognized as what she has always identified as—a woman.
