"Instructions for False Time Records at Work"... Allegations of Labor Rights Violations by Employees at Child Welfare Facility Songjukwon

Employees at Songjukwon, a child welfare facility in Seoul, allege serious labor rights violations, including being instructed to falsify working hours and not receiving proper overtime pay.

The workers at Songjukwon, a child care facility in Seoul operated by the Social Welfare Corporation, have come forward with allegations of violations against labor laws, including the failure to pay proper overtime wages and instances of workplace harassment. Labor rights group Workplace Injustice 119 has submitted a petition to the Seoul branch of the Ministry of Employment and Labor, urging an investigation into these violations. The facility serves over 40 children, including infants, and employs around 30 childcare workers and 14 administrative staff.

An anonymous employee, referred to as 'C,' claims they received directives to inaccurately record their actual clock-in and clock-out times. To meet the city's overtime wage support criteria, which allows for a maximum of 40 hours of overtime per month, employees have been instructed to falsify their overtime records. This has left 'C' unable to receive appropriate compensation for their overtime work. Furthermore, a labor consultant representing 'C' noted discrepancies revealed through a comparison of actual time records with submitted overtime forms, indicating possible manipulation of clock-out times by up to an hour and a half.

The allegations further extend to inadequate breaks during night shifts, where employees reported that they were not provided sleeping spaces despite being designated rest periods. Meeting minutes from staff meetings also indicated that during scheduled breaks, employees were still assigned duties related to children's meals. This complaint follows previous reports of wage arrears and workplace harassment received by the labor department earlier in January from other employees. Another worker, 'B,' who claimed to be using a reduced working hours system due to parental responsibilities, reported ongoing overtime and weekend shifts, also highlighting inappropriate remarks made by the facility head regarding personal matters unrelated to work.
