Supermarket is ordered to pay R$ 20,000 to customer struck by two bags of pet food on the head
A supermarket in Campo Grande, Brazil, has been ordered to pay R$ 20,000 to a customer after two bags of pet food fell on her head, resulting in hospitalization.
A supermarket in Campo Grande, Brazil, faced legal repercussions after an incident where a customer was struck on the head by two bags of pet food. This accident occurred in September 2024 when the customer was shopping inside the store. The bags, each weighing 10 kilograms, fell from a height of approximately five meters, causing the customer to sustain injuries that led to her hospitalization. The court ruling, issued by the Mato Grosso do Sul Court of Justice (TJMS) on Monday, confirmed the supermarket's liability in the incident and established a compensation amount of R$ 20,000 for the affected customer.
Following the accident, the customer experienced pain and dizziness, prompting a call for assistance from the Fire Department. She was subsequently admitted to the Santa Casa hospital in Campo Grande, where she remained for four days under medical care for her head and neck injuries. The supermarket contested the ruling, downplaying the severity of the customer’s injuries and seeking a reduction in the monetary compensation. However, the court held that the injuries were indeed significant and directly caused by the falling bags of pet food.
This case highlights important issues regarding consumer safety and corporate responsibility in Brazil's grocery sector. The ruling sends a clear message about the obligation of supermarkets and similar establishments to ensure the safety of their customers within their premises. It also raises awareness about the potential hazards present in retail environments, reinforcing the need for compliance with safety regulations to prevent similar incidents in the future.
