Justice condemns man to pay R$ 10,000 to trans woman treated with masculine terms
A Brazilian court has ordered a man to pay R$ 10,000 in moral damages to a transgender woman who was referred to using masculine terms, highlighting issues of discrimination and gender identity.
A SΓ£o Paulo court has ruled that a man must compensate a transgender woman R$ 10,000 for moral damages after she was addressed with masculine terms during her employment. This incident occurred while she was working as an inspector in a supermarket on April 29, 2024. The woman contested the treatment by filing a police report, which led to the legal proceedings against the man.
The judgment, issued by Judge Γngelo MΓ‘rcio de Siqueira Pace on March 4, highlights that the woman endured significant emotional distress due to being misgendered. Despite identifying as female, she was repeatedly addressed in masculine language, causing her considerable embarrassment and distress. The court recognized that such treatment constitutes a serious offense, going beyond ordinary inconveniences to which individuals may be subjected.
This ruling represents an important step in recognizing and addressing discrimination against transgender individuals in Brazil. The judge emphasized that the recurrent use of inappropriate terms that conflict with the individual's identified gender is not merely an annoyance, but an act of discrimination. The case currently remains subject to appeal, and the outcome may set a precedent for future instances of gender identity discrimination in the workplace.
