The judges have ordered the preventive seizure of the construction site at Papiniano 48 following an appeal by the prosecutors, overturning a prior decision that favored the builders.
The building located at 48 Papiniano Avenue is back in the spotlight as the Court of Review has ordered its preventive seizure. This decision comes after a previous ruling by Judge Sonia Mancini did not approve the seizure requested by the public prosecution in November, which had claimed that the site's construction was tangled in several investigations regarding urban planning misdeeds including illegal building activities and land subdivision. Initially, the judge deemed the builder and the site manager to have acted in 'good faith', but the Court of Review argued against this conclusion.
The Court of Review, led by judges Galli, Nosenzo, and Guadagnino, determined that there was no 'innocent reliance' from the builders, thereby allowing the prosecutors, Giovanna Cavalleri, Luisa Baima Bollone, and the deputy Paolo Ielo, to move forward with the seizure. The previous ruling pointed out that the accused were not culpable due to 'fluctuating municipal practices', which had initially mandated compliance from the builders, only to be denied later under 'opportunistic' motives amidst ongoing investigations.
