Kenya: Kutrrh Releases Body Held Over Hospital Sh750,346 Bill After Ombudsman Intervention

The Kenyatta University Teaching, Referral & Research Hospital released a deceased patient's body after the Kenyan Ombudsman intervened due to a complaint about unlawful detention over an unpaid bill.

The issue arose when Kenyatta University Teaching, Referral & Research Hospital detained the body of W.K., who passed away on November 3, 2025, due to an outstanding hospital bill of Sh750,346. The action of holding the body against the family's will prompted M.N., a relative of the deceased, to file a complaint with the Commission on Administrative Justice, claiming that the hospital's actions were unlawful.

In response to the complaint, the Ombudsman launched an investigation and reached out to the hospital's CEO for clarification, referencing constitutional provisions that uphold human dignity and the fundamental rights of individuals. This pressure led to the hospital re-evaluating its stance, ultimately deciding to release the body, thus resolving the matter following affirmation of rights protection.

This incident highlights ongoing issues in the Kenyan healthcare system regarding the treatment of patients and their families, particularly in instances where financial constraints clash with ethical obligations. The intervention by the Commission on Administrative Justice emphasizes the importance of oversight in ensuring adherence to human rights principles in healthcare settings, ensuring that such occurrences are addressed promptly to avoid similar situations in the future.
