TJMG maintains payment of new aid to those affected by the dam collapse in Brumadinho
The Minas Gerais Court of Justice has unanimously decided to continue the payment of new emergency aid for victims of the 2019 dam collapse in Brumadinho.
The Minas Gerais Court of Justice (TJMG) has upheld the payment of new emergency assistance meant for victims of the Córrego do Feijão dam collapse in Brumadinho, which occurred in 2019. This unanimous decision was made during a session on the 5th of October, 2023, in which the court's 19th Civil Chamber reviewed a challenge posed by Vale S/A against an earlier ruling. The initial judgement by Judge Murilo Sílvio de Abreu from Belo Horizonte's 2nd Public Treasury and Administrative Court granted a preliminary injunction favoring associations representing those affected by the disaster, which resulted in hundreds of fatalities and serious environmental impacts.
The legal situation stems from a previous agreement established in 2021, which allocated R$ 4.4 billion for the Income Transfer Program (PTR) managed by the Getúlio Vargas Foundation (FGV). This financial assistance was aimed at supporting the families impacted by the disaster. However, it has been pointed out that the allocated funds were not sufficient to restore the pre-disaster financial stability for the affected communities, raising concerns about the adequacy of the government response in the aftermath of such a catastrophic event.
As the verdict removes obstacles for the continuation of aid, it is a significant step for those still grappling with the repercussions of the tragic event. The court's ruling highlights the ongoing responsibility of companies and government bodies to ensure that the needs of affected populations are adequately addressed, especially in light of the magnitude of the disaster and the long-term effects on the local community.
