Nigeria: Court Acquits Abba Kyari of 23-Count Asset Declaration Charge
The Federal High Court of Abuja has acquitted Abba Kyari of charges related to non-declaration of assets due to insufficient evidence from the prosecution.
The Federal High Court in Abuja has acquitted Abba Kyari, a suspended Deputy Commissioner of Police, of a 23-count asset declaration charge put forth by the National Drug Law Enforcement Agency (NDLEA). The judgment, delivered by Justice James Omotosho, found that the prosecution failed to present adequate evidence to support its claims against Kyari and his two brothers, who were also accused of fraud regarding property declarations.
In his ruling, Justice Omotosho emphasized that credible evidence linking Kyari to the properties in question was lacking, particularly in relation to properties claimed to belong to Ramatu Kyari. He remarked that the prosecution did not produce sufficient documents, traditional history, or other forms of possession evidence to establish ownership of the land in Fountain Estate, Kasana, or the properties on Linda Choko Road in Asokoro and Maiduguri, Borno State.
The court's decision underscores the challenges faced by prosecuting agencies in substantiating serious allegations against public figures, especially in cases involving asset declarations. This ruling could have significant implications for similar cases in Nigeria, reflecting ongoing issues around transparency and accountability within law enforcement and public officials.
