She said she was raped by two men, but it was false: a key video and a 3-year sentence

Fiorella Belén Damiani was sentenced to three years of suspended prison for false testimony after falsely accusing two men of rape in Argentina.

In a case that has garnered attention in Argentina, Fiorella Belén Damiani, a 27-year-old former school counselor from Bahía Blanca, was found guilty of making false accusations against two men in 2017, claiming they had raped her following a party in Punta Alta. It was revealed through key video evidence that her assertions were not true, leading to her indictment for aggravated false testimony.

The ruling was handed down by Judge Ricardo Gutiérrez of the Criminal Oral Court No. 1, who sentenced Damiani to three years of conditional imprisonment, meaning she will not serve time in jail but will face significant restrictions. Alongside the prison term, Damiani was also subjected to a special disqualification for the duration of her sentence, preventing her from testifying as a witness, and must adhere to conduct regulations, which include establishing a residence and being monitored by the Patronato de Liberados.

During the closing arguments, prosecutor Mauricio del Cero had requested an even harsher penalty of nine years in prison for Damiani, reflecting the severity of the case and the broader implications of falsely accusing someone of such a serious crime. This verdict highlights the importance of truthfulness in legal testimonies and the potential consequences of deceit in the justice system, particularly in sensitive cases involving allegations of sexual violence.
