The Absolute Ban for Pharmacies Has Been Lifted. Head of GIF on Penalties

Following a ruling by the CJEU, the absolute ban on pharmacy advertising in Poland has been lifted, prompting new legislative responses.

The Court of Justice of the European Union (CJEU) ruled on June 19, 2025, that the total ban on advertising pharmacies in Poland was unlawful, leading to its suspension. In response to this decision, the Polish Ministry of Health has introduced a draft amendment to pharmaceutical law, allowing pharmacies to begin advertising once again, similar to practices before the ban was enacted.

As a consequence of the ruling, administrative courts have started overturning decisions made by the Chief Pharmaceutical Inspector (GIF) regarding penalties for pharmacy advertising, including those from concluded cases. These reversals mean that regional pharmaceutical inspectors are now obligated to refund penalties, which could amount to as much as 11 million PLN, in addition to litigation costs. This situation highlights the financial implications of the court's decision on the regulation of advertising within the pharmaceutical sector in Poland.

GIF head Łukasz Pietrzak has warned that a delay in swiftly amending the pharmaceutical law and failing to comply with the CJEU ruling could expose Poland to further financial penalties from the European Union. His comments underscore the urgency for legislative action to avoid potential repercussions, emphasizing the need for compliance in the face of evolving regulations surrounding pharmacy advertising.
