The National Appeal Chamber questions Budimex's self-cleaning

The National Appeal Chamber has upheld a ruling stating that Budimex's companies engaged in illegal collusion, raising concerns over their future participation in public tenders.

The issues facing the Budimex group stem from a December ruling by the Public Procurement Court (SZP), which upheld an earlier decision by the National Appeal Chamber. This decision concluded that three companies within the Budimex group had engaged in illegal collusion by coordinating their bids in a tender for the construction of high-voltage power lines from offshore wind farms. As a consequence, these companies were excluded from the Polish Power Grid tenders in February. This legal predicament not only jeopardizes Budimex's current standing in tenders but may also lead to their exclusion from future tenders for a period of three years, as stipulated by Article 108, paragraph 1, point 5 of the public procurement law.
