Understand the rules for the 2026 election approved by the TSE

The TSE has approved a series of regulations for the 2026 elections, including restrictions on the use of AI-generated content.

The TSE (Tribunal Superior Eleitoral) has approved new regulations for the upcoming 2026 elections during sessions held recently. In total, the tribunal voted on norms covering 12 distinct topics, such as the electoral calendar, electoral offenses, the registration process for candidates, and campaign financial reporting requirements. A significant restriction is the prohibition on the use of generated or manipulated content by artificial intelligence in the 72 hours leading up to and following the election day, along with new obligations aimed at social media platforms.

The updates to these electoral rules are part of an ongoing effort by the tribunal, which traditionally reviews its resolutions before each election. This year's process has been led by the vice president of the court, Minister Kassio Nunes Marques. In January, drafts of the resolutions were circulated, allowing for input from experts, political parties, and civil society. After gathering feedback, a specialized team from the tribunal, coordinated by the minister, drafted the final versions of the approved regulations.

These new rules are expected to significantly impact campaign strategies and the use of technology, notably by restricting the practice of employing AI in political messaging at crucial times. This decision reflects broader concerns regarding misinformation and the integrity of electoral processes in Brazil, showing a commitment from the TSE to uphold transparency and fair practices in the democratic process.
