Namibia: NBC Seeks High Court Order to Stop Property Sale Linked to Ex-Employee Dispute
The Namibian Broadcasting Corporation (NBC) is seeking a High Court order to prevent the sale of its property linked to a dispute with former employee Johannes Gaseb over unpaid arbitration awards.
The Namibian Broadcasting Corporation (NBC) has taken legal action by applying for an urgent court interdict aimed at stopping the sale of its property. The situation stems from a dispute with former employee Johannes Gaseb, who won a claim for unfair dismissal that led to the Labour Commissioner awarding him N$295,026 following arbitration. The NBC has failed to make the required payment to Gaseb, which has prompted him to pursue a writ of execution to recover the owed amount through property seizure.
In a hearing scheduled for Friday, NBC's director general, Stanley Similo, is requesting the High Court to not only stop the property sale but also to prevent Gaseb from taking further steps to execute the writ of execution. Additionally, the NBC claims that Gaseb owes the company a debt of N$186,000 resulting from a housing loan he received while employed there. Similo further argues that this debt should offset the amount Gaseb is owed by the NBC, or alternatively, the court should grant a remedy it finds appropriate.
This case highlights the ongoing legal and financial disputes within the Namibian Broadcasting Corporation, which is dealing with the ramifications of an employee dismissal case that has financial implications not only for Gaseb but also for the corporation itself.
