Justice reduces compensation to the family of one of the young people run over in front of a club in Cuiabá

A Brazilian court has reduced the compensation awarded to the family of a young man killed in a hit-and-run incident in Cuiabá by 50% due to shared fault.

A ruling by the Third Chamber of Private Law of the Mato Grosso Court of Justice has significantly reduced the compensation awarded to the family of Ramon Alcides Viveiros, who died after being struck by a vehicle outside the Valley Pub nightclub in Cuiabá. Initially set at R$ 1,056,000, the compensation has now been halved to R$ 500,000, with the court attributing equal blame to both the driver and the pedestrians for the tragic incident that transpired in 2018.

According to the court's decision, the blame for the accident is shared between the driver, Rafaela Screnci da Costa Ribeiro, and the victims, as the pedestrians failed to use the designated crosswalk. This ruling highlights the concept of "culpa concorrente," or joint negligence, suggesting that both parties contributed to the accident's occurrence. Each of the two defendants is now responsible for R$ 125,000 of the resulting compensation.

The decision underscores the judicial system's stance on pedestrian safety and accountability, indicating that even in tragic circumstances, the actions of individuals must be taken into account.
