The Korean court has recognized the authority of the Corruption Investigation Agency to investigate insurrection charges against former President Yoon Suk-yeol.
On the 19th, during the sentencing hearing for former President Yoon Suk-yeol regarding his role as a leader in an insurrection, the Seoul Central District Court ruled that the Corruption Investigation Agency (CPIA) has the authority to initiate investigations into cases of insurrection. Judge Ji Gwi-yeon stated that if the court were to accept arguments that deny the CPIA's ability to initiate such investigations, it would imply that cases involving non-investigative crimes would automatically be delegated to the police rather than the CPIA. Therefore, a broader interpretation of the CPIA's investigative authority is warranted, which aligns with the principle of not infringing upon victims' rights, as long as it does not contravene CPIA Law.
