The Bar Association of CABA expressed its concern over articles of the Labor Reform affecting labor lawyers
The Bar Association of CABA has expressed deep concern regarding the potential impact of the current labor reform project on labor lawyers' professional practices in Argentina.
The Public Bar Association of the City of Buenos Aires, led by former judge Ricardo Gil Lavedra, recently sent a letter to the president of the National Chamber of Deputies, MartΓn Menem, and to the leaders of various parliamentary blocs, expressing deep concern over the possible consequences of the approval of the labor reform project currently under debate. The association argues that this initiative must be scrutinized in light of the rights and guarantees enshrined in the National Constitution and the international commitments undertaken by Argentina concerning labor protection.
In their correspondence, the Bar Association highlighted the structural asymmetry that characterizes the employment relationship between workers and employers, emphasizing that any normative update should not exceed constitutional limits or weaken existing protective standards. They stated that it is crucial to consider these implications carefully, as the labor reform could significantly alter the balance within the employer-employee dynamic.
As the labor reform discussion continues, the Bar Association's position reflects broader concerns regarding workers' rights and the legal profession's role in advocating for these rights. The anticipated influence of the reform on the legal handling of labor disputes underscores the importance of ensuring that such legislative changes uphold the constitutional protections designed to safeguard workers' interests throughout Argentina.
