Supreme Court cancels acquittal of farmer whose calf killed neighbor

Lithuania's Supreme Court has revoked the acquittal of a farmer whose calf fatally injured a neighbor, reinstating the original conviction on a lesser charge of negligent manslaughter.

In a recent ruling, Lithuania's Supreme Court (LAT) annulled an earlier acquittal of a farmer, D. Mikužytė, connected to the death of a neighbor caused by her calf. The farmer was initially convicted of negligent manslaughter, as she failed to prevent her cattle from wandering outside their grazing area. The incident occurred when her aggressive calf escaped through a broken electric fence and attacked the neighbor, resulting in serious injury and eventual death. The case was appealed, and the appellate court ruled in favor of Mikužytė, leading to her acquittal. However, the Supreme Court has now overturned this decision, emphasizing that the measures the farmer took to confine her animals were inadequate and posed unnecessary risks to the public. The court noted that having aggressive livestock, even in a supposedly controlled environment, raised significant safety concerns. Consequently, the Supreme Court not only reinstated the original guilty verdict but also reclassified the charge under a less severe provision of the Criminal Code. This ruling underscores the ongoing legal complexities surrounding animal husbandry and owner responsibility, particularly in cases where domestic animals cause harm to others.
