Kenya: Ombudsman Seeks Prosecution of Nairobi Officials Over Illegal Building Approvals

The Ombudsman has called for the prosecution of Nairobi officials for their involvement in approving illegal building developments.

The Commission on Administrative Justice in Kenya, also known as the Office of the Ombudsman, has formally recommended that several high-ranking officials in the Nairobi City County be prosecuted for their roles in approving unlawful building developments. This significant action highlights ongoing concerns about corruption and mismanagement within local government operations. The investigation identifies key individuals within the Urban Planning Department, emphasizing accountability in urban development initiatives in the capital city.

According to the Ombudsman, the implicated officials, including former Built Environment and Urban Planning Chief Executive Committee Member Stephen Mwangi, have been found culpable for their part in sanctioning illegal constructions that not only undermine regulatory standards but also potentially jeopardize public safety. This recommendation urges the Director of Public Prosecutions (DPP) to initiate criminal proceedings against these individuals and calls for immediate disciplinary action by the Nairobi City County Public Service Board.

The Ombudsman has stipulated a timeline of one month for the DPP to provide updates on the prosecution's status, suggesting the urgency and seriousness of the matter. This situation reflects a growing push for governance reform in Nairobi, aiming to address the misappropriation of authority and ensure that urban planning processes are conducted lawfully and transparently, safeguarding the interests of citizens and promoting sustainable urban development overall.
