This year, an increasing number of voters in Brazil may rely on generative artificial intelligence to inquire about candidates and political parties, a trend that presents significant risks. The responses generated by these AI systems are often opaque and lack transparent sources or mechanisms for accountability, leading to potential misinformation in electoral contexts. While the Superior Electoral Court has proposed changes to electoral rules, these do not specifically address the dangers posed by generative AI to electoral integrity, missing an opportunity to protect voters from unreliable information sources.

Current regulations in Brazil, such as the resolution regarding political advertising (23.610/2019), prohibit deepfakes and demand labeling for synthetic audiovisual content; however, they do not encompass the information produced by AI models when voters use them as political information sources. The increasing consumption of information through digital platforms such as Google, Instagram, YouTube, and WhatsApp further complicates the scenario, as these platforms recently integrated generative AI tools, affecting how information is disseminated and consumed by the public. This shift towards digital and AI-driven information could amplify existing biases and misinformation.

As the electoral landscape in Brazil evolves with new technologies, there is a pressing need for regulatory frameworks that incorporate the implications of AI in shaping political discourse. A lack of adequate guidelines could undermine the electoral process, potentially leading to poor decision-making based on questionable or misleading information. Stakeholders must establish clear and effective measures to ensure that voters can make informed choices based on accurate information, protecting the integrity of the democratic process while navigating the complexities introduced by advanced technologies.
